utu Privileges Terms & Conditions

  1. DEFINITIONS
    1. In these utu Privileges Terms, the following words shall have the following meanings:
      “Member” : shall mean any registered User/individual using the Utu App.
      “Partner” : shall mean any participating retailer or merchant issuing the Rewards on the Utu App.
      “Goods” : shall mean any tangible item including food and beverages.
      “Rewards” or “Reward” : shall mean any and all vouchers issued by each respective Partner displayed on the Utu App.
      “utu Privileges Terms” : shall mean this utu Privileges Terms and Conditions.
  2. ACCEPTANCE OF UTU PRIVILEGES TERMS
    1. These utu Privileges Terms shall govern the use of the Rewards offered by utu. By participating or using the Rewards, the Member acknowledges and agrees to be bound by these utu Privileges Terms and the utu General Terms and Conditions. The utu General Terms and Conditions shall be read together with these utu Privileges Terms.
  3. USE OF REWARDS
    1. All Rewards will only be redeemable at the issuing Partner’s outlet.
    2. All Rewards redemptions are non-transferable, non-monetary, non-refundable in any currency, nor exchangeable to any other value or promise of utility.
    3. Redemption of Rewards must only be done through specified interaction between the utu Partner and Utu App, no other forms i.e. screenshots of the Rewards will be accepted.
    4. This Rewards can only be used on regular priced items/goods unless the Partner communicates to the Member otherwise.
    5. Each Rewards is valid only for a single redemption.
    6. The Rewards shall only be valid for seven (7) days from the date of issue, the Reward is displayed on Member’s utu app, after which, the Rewards will expire and may no longer be used.
    7. Each Reward may only be used to purchase goods up to the numeral value displayed on the Reward and may be supplemented with cash or other means of payments, shall the cost of the goods exceed the numeral value of the Reward.
    8. No refunds shall be given if the value of the goods purchased by the Member amount to below the value of the Reward.
    9. The Member shall be liable for actual loss arising from an unauthorized transaction/use of the Reward, where such Member’s recklessness was the primary cause of loss.
  4. LOSS OF REWARDS
    1. The Reward cannot be replaced if it is lost, stolen, or in utu’s opinion, has been unlawfully obtained, or has expired or been voided, or is or appears to be counterfeit or altered, defaced, damaged, or tampered with (as applicable). utu shall not be liable or required to replace any such Reward. utu’s decision on the replacement of any Reward shall be absolute and binding on the Member.
    2. Each Reward is used at the sole risk of the Member. A Partner may decline to accept any Reward which has been unlawfully obtained, or has expired or been voided, or is or appears to be counterfeit or altered, defaced, damaged, or tampered with.
  5. WARRANTY DISCLAIMER
    1. utu makes no warranties (including, without limitation, defects, quality, damage or fit for purpose thereof) regarding the goods purchased from any Partner’s with the use of the Rewards.
    2. Warranty (If any) shall be honoured by the respective Partners. Members will have to produce the original receipt. Any warranty claims for goods shall be at the absolute discretion of the respective Partner.
    3. Any and all decisions on warranty claims by the respective Partner are final and conclusive.
  6. EXCLUSION OF LIABILITY
    1. utu shall not be liable for any damages, loss or inconvenience, cost and expense of any nature (including, without limitation for any act, omission, neglect or wilful default on the part of the Partners and/or their respective officers and employees) which in any way may be suffered or incurred by the Member in respect of or in connection with the use of the Rewards. The Member will release and discharge utu from all claims in relation to the above-mentioned loss, damage, cost and/or expense.
    2. The Member shall indemnify utu and keep utu indemnified against any loss, damage, liability, cost and expense (including legal costs and disbursements on a full indemnity basis), whether directly or indirectly arising from Member’s use of the Rewards.
  7. GENERAL TERMS
    1. These Terms may be translated into other languages but in the event of any inconsistency, the English version shall prevail.
    2. In the event of any inconsistency between these Terms and any other form of publicity relating to the Rewards, these Terms shall prevail.
    3. Any decision on all matters relating to the Rewards made by utu will be final, conclusive and binding on all Members.
    4. utu reserves the right to add, modify, or remove any content of these utu Privileges Terms without notice to the Member.
    5. utu may at its absolute and sole discretion, without prior notice to Members, suspend or terminate the Rewards for any reason whatsoever as utu may deem fit.
